Terms and Conditions of Membership with the Musical Theater Society Berlin (MTS Berlin)

1. Membership Benefits 

As a member of the Musical Theater Society Berlin (MTS Berlin), you are entitled to the following benefits:

• A 30% discount on all classes offered by MTS Berlin.

• Access to a limited number of discounted tickets available exclusively to members for MTS Berlin performances and events.

• Eligibility to purchase exclusive MTS Berlin merchandise, available only to members.

2. Membership Obligations  

By accepting membership with MTS Berlin, you agree to the following obligations:

• Active Participation: You are expected to actively participate in classes, rehearsals, performances, and other activities as agreed upon when joining each class or show. Failure to meet these commitments may result in the review and potential revocation of your membership.

• Conduct: You must conduct yourself in a manner that upholds the harmony, safety, and well-being of the group. Any behavior that disrupts the positive environment of the society may lead to membership termination. This includes, but is not limited to, disrespectful behavior towards other members, instructors, or staff, and failure to adhere to agreed-upon rules or guidelines.

• Health and Safety: You are obligated to inform LAUREN STEPHENS in writing of any existing or developing health conditions, allergies, or other medical issues that could affect your participation in MTS Berlin activities. This includes, but is not limited to, physical injuries, chronic conditions, or sudden health concerns. MTS Berlin is not liable for any health issues or injuries that arise if you have failed to disclose relevant health information. Your safety and well-being are paramount, and MTS Berlin relies on your transparency to provide a safe environment for all participants.

• Property and Equipment: If you borrow any items, materials, or equipment from MTS Berlin, you are expected to return them in the same condition as they were provided. Failure to return borrowed items will result in you being sent an invoice for the full replacement cost. If any items are damaged, lost, or broken while in your possession, the handling of this situation will be at the discretion of the MTS Berlin creative team. In cases where gross negligence is suspected, MTS Berlin reserves the right to involve their insurance providers or legal counsel to determine liability.

3. Grounds for Membership Termination  

MTS Berlin reserves the right to terminate your membership under the following circumstances:

• Reimbursable Termination: Your membership may be terminated, with a reimbursement of any remaining membership fees, if:

• Your actions or behavior are found to disrupt the harmony and cohesion of the group. For example, consistently failing to meet rehearsal or class commitments, spreading rumors or misinformation that creates discord, or other behaviors that negatively affect the group dynamic.

• Your dedication to the society is brought into question, such as through repeated absences, lack of preparation, or failing to contribute to the group's goals and objectives.

• It is determined, at the discretion of MTS Berlin, that your continued membership is not in the best interest of the group.

• Re-Auditioning: If your membership is revoked under this category, you will be eligible to re-audition for an MTS Berlin show after a period of 6 months. Re-auditioning will only be allowed upon the approval of the MTS Berlin creative team.

• Non-Reimbursable Termination: Your membership may be terminated without reimbursement if:

• You engage in illegal activities while representing MTS Berlin or at any MTS Berlin event or class. This includes, but is not limited to, theft, vandalism, or any activity that violates local, national, or international law.

• You compromise the safety of the group or any of its members through gross negligence or willful misconduct. For example, disclosing sensitive information that endangers members, or behaving recklessly during physical activities that could result in injury.

•  You publicly express or promote extremist views, hate speech, or any form of discrimination that contradicts the inclusive values of MTS Berlin.

• You are under active criminal investigation or have been convicted of a crime that MTS Berlin deems incompatible with the values and safety of the society.

• You engage in actions that could significantly damage the reputation of MTS Berlin, such as publicizing false information about the society or its members on social media or other public platforms.

• Lifetime Ban: If your membership is revoked under this category, you will be permanently banned from MTS Berlin, with no possibility of rejoining or participating in future MTS Berlin activities.

4. Membership Fees and Refund Policy  

• Membership fees are non-refundable except in cases where MTS Berlin terminates your membership under the "Reimbursable Termination" category as outlined above

• If you choose to voluntarily withdraw from membership, no refund of fees will be provided.

5. Property Damage and Liability  

•  Damage to MTS Property: If you cause damage to MTS Berlin property, the assessment and handling of the situation will be at the discretion of the MTS Berlin creative team. In cases where gross negligence is suspected, MTS Berlin reserves the right to involve their insurance providers or legal counsel to determine responsibility and liability.

• Personal Liability Insurance: MTS Berlin strongly recommends that all members carry personal liability insurance to cover any potential costs related to damages or accidents. In the absence of such insurance, any costs associated with damage you cause will be billed directly to you.

6. Amendments to Terms and Conditions  

MTS Berlin reserves the right to amend these terms and conditions at any time. Members will be notified of any changes via email or other appropriate communication channels. Continued membership following the notice of such changes constitutes acceptance of the revised terms.

7. Privacy and Data Protection  

MTS Berlin is committed to protecting your personal information. Your data will be stored and used in compliance with applicable data protection laws. MTS Berlin will not share your information with third parties without your consent, except where required by law.

8. Governing Law  

These terms and conditions are governed by the laws of Germany. Any disputes arising from your membership with MTS Berlin will be subject to the jurisdiction of the courts in Berlin.

By becoming a member of MTS Berlin, you acknowledge that you have read, understood, and agree to these terms and conditions.
